By using the Site, whether as a visitor, prospective client, or active client, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, please do not use the Site.
Ownership
The Site is owned and operated by Trek Advancement, LLC, a Kentucky limited liability company. In these Terms, “Trek Advancement,” “we,” “us,” and “our” refer to Trek Advancement, LLC, and “you” and “your” refer to any user of the Site.
- Changes to these Terms. We may modify these Terms at any time. When we do, we will update the “Effective” date at the top of this page. Your continued use of the Site after a change takes effect constitutes your acceptance of the revised Terms.
- Use restrictions. You may use the Site and its content for lawful, non-commercial purposes only, and for purposes connected to a Trek Advancement engagement where applicable. You may not republish, distribute, resell, or modify Site content without our express written permission.
- Intellectual property. The Site and its content — including designs, text, graphics, logos, photographs, audio, video, software, and the arrangement of all of the foregoing — are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, all rights are reserved by Trek Advancement and its licensors.
- Accounts and authentication. Certain areas of the Site — including the client portal — require an account. You may create an account using an email address or by signing in through a supported third-party identity provider (such as Google). You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that we reasonably believe have been compromised, are inactive, or are being used in violation of these Terms.
- Legal compliance and respect for others. You agree to use the Site in a manner that complies with all applicable laws and that respects the rights of others, including intellectual property, privacy, and publicity rights.
- Online conduct. You are responsible for the content of your communications through the Site, the client portal, and our social media channels. You agree not to post, transmit, or upload material that is unlawful, harmful, threatening, abusive, defamatory, obscene, infringing, or otherwise objectionable; that contains malware or other harmful code; or that interferes with the operation of the Site or the experience of other users.
- Content moderation. We have the right, but not the obligation, to monitor, review, or remove any content posted or submitted through the Site that we believe violates these Terms or is otherwise objectionable. We may also suspend or terminate access for users who violate these Terms.
- User content. If you submit content through the Site — including messages, documents, files, or feedback — you retain ownership of that content, and you grant Trek Advancement a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process that content as necessary to provide the Site and any engagement you have requested. You are solely responsible for the content you submit and for ensuring that you have the rights necessary to grant this license.
- Disclaimer of warranties. The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, all warranties are disclaimed.
- Limitation of liability. Your use of the Site is at your own risk. To the maximum extent permitted by law, Trek Advancement and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages.
- Indemnification. You agree to indemnify, defend, and hold harmless Trek Advancement and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your submitted content, or your violation of these Terms or any applicable law.
- Links to other sites. The Site may link to third-party websites that we do not control or operate. We are not responsible for the content, policies, or practices of those sites, and your use of them is at your own risk.
- Trademark information. Trek Advancement™ and related logos, taglines, and design marks are trademarks of Trek Advancement, LLC. You may not use any of our trademarks without our prior written consent.
- Copyright. You agree not to use or register any name, logo, or insignia of Trek Advancement, or of any of our affiliated projects or brands, for any purpose except with our prior written approval and in accordance with any conditions we may require. Parties are welcome to send a written request seeking approval. If you believe that your copyright has been infringed on the Site, please contact us.
- Dispute resolution. You agree to attempt to resolve any dispute arising out of or related to these Terms through good-faith negotiation, and if necessary mediation, before initiating any legal proceeding.
- SMS messaging. If you provide your mobile number, you consent to receive transactional or service-related text messages from us at that number, consistent with your separate consent and applicable law. Message and data rates may apply. You can opt out at any time by replying STOP to any such message.
- Governing law and venue. These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in the Commonwealth of Kentucky for the resolution of any dispute that is not resolved under Section 15.
- Your rights are personal. Your rights under these Terms are personal to you and are not transferable or assignable without our prior written consent.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Entire agreement. These Terms, together with our Privacy Policy and any written engagement agreement between you (or your organization) and Trek Advancement, constitute the entire agreement between you and Trek Advancement with respect to the Site and supersede any prior agreements on that subject.
